KASHILAND RELEASE OF LIABILITY AND ASSUMPTION OF RISKS AGREEMENT

NOTE: THIS FORM MUST BE READ, SIGNED AND NOTARIZED BEFORE THE PARTICIPANT IS ALLOWED TO TAKE PART IN ANY AIRSOFT EVENT.

PARTICIPANTS NAME_________________________________DATE OF BIRTH_________________ (Please print) IN CONSIDERATION of being permitted to participate in any way in the sport activities of Airsoft under the auspices of Kashiland, and for other good and adequate consideration, the receipt and sufficiency of which is hereby acknowledged, I acknowledge, appreciate and agree that:

1. The risk of injury from the activity and weaponry involved in Airsoft is significant, including the potential for permanent disability and death, and while particular protective equipment and personal discipline will minimize this risk, the risk of serious injury does exist.

2. There is the chance of being injured by running into props, trees, poisonous snakes, other players and undesirable vegetation as a result of playing Airsoft outdoors.

3. I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE of those persons released from liability herein, and assume full responsibility for my participation; and

4. I understand that the activities of Airsoft are physically and mentally intense. I understand the rules of play and will comply with all rules and regulations. If I observe any unusual or unnecessary hazard during my participation, I will bring such to the attention of the nearest official as soon as practical; and

5. On behalf of myself and on behalf of my heirs, assigns, personal representatives and next of kin, I HEREBY RELEASE THE OWNERS AND OPERATORS of Kashiland and all of those persons acting by, through or on behalf of Kashiland or otherwise involved in conducting the Airsoft activities (Releasees) which includes, but is not limited to, owners of property used, WITH RESPECT TO ANY AND ALL INJURY, DISABILITY, DEATH and loss or damage to person or property, WHETHER CAUSED BY THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, except that which is the result of gross negligence and/or wanton misconduct. I also agree to INDEMNIFY AND HOLD HARMLESS the Releasees from all claims, judgments and costs, including attorneys fees, incurred in connection with any action brought as a result of my participation in or observation of the activities of Airsoft.

6. I understand and agree that this Release of Liability Agreement covers each and every Airsoft activity and event in which I participate on this date and hereafter.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, I FULLY UNDERSTAND ITS TERMS, I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

PARENT OR GUARDIAN MUST READ THIS FORM AND SIGN BELOW

This is to certify that I, as parent/guardian with legal responsibility for this participant, do consent and agree not only to his/her release of Kashiland and all other Releasees, but also I agree to release and indemnify and hold harmless the Releasees from any and all liabilities incident to said participants involvement in these programs of behalf of myself, my heirs, assigns and next of kin.
